The online sales website www.koesio-parfums.com is managed by the company MORAFLOR SARL with a share capital of €150,000, headquartered at ZAC PILON LOT N°7 - 06460 SAINT VALLIER DE THIEY (GRASSE-FRANCE), registered with the Trade and Companies Registry of Grasse under number 330 548 355 00040.

It is hereby specified that these conditions govern the sales of its products by MORAFLOR to any natural or legal person making a purchase via the website www.koesio-parfums.com, hereinafter referred to as "the CLIENT".

These General Terms and Conditions of Sale, as well as the order form and the order confirmation, constitute the sales contract between MORAFLOR and the CLIENT relating to the sale of the ordered products.

Any order placed on the website www.koesio-parfums.com requires the CLIENT to accept in full and without reservation the General Terms and Conditions of Sale.

In the event of disagreement with the terms and conditions of the General Terms and Conditions of Sale, the CLIENT must not use the Website.

MORAFLOR reserves the right to adapt or modify its General Terms and Conditions of Sale at any time and without notice, with such adaptations or modifications then applying to all orders placed after such adaptations or modifications.

In the event of modification, the General Terms and Conditions of Sale applicable to the CLIENT's order are those which were online and accepted by the CLIENT on the day of placing the order.

The terms and expressions identified by a capital letter in the General Terms and Conditions of Sale have the meanings indicated below (whether used in the singular or plural).

• Order  : refers to the purchase order placed by the CLIENT for one or more Product(s) or Service(s) through the website www.koesio-parfums.com or via Customer Service.

• Website : refers to the website accessible at the address www.koesio-parfums.com.

• Product    : refers to a product or service offered for sale on the website www.koesio-parfums.com.

• CONSUMER  : refers to a natural or legal person, consumer, who uses the website www.koesio-parfums.com and acquires one or more Product(s), for personal use, having previously adhered to the General Terms and Conditions of Sale.

Article 2. Object

These General Terms and Conditions of Sale aim to define the contractual relations between MORAFLOR and the CLIENT and the conditions applicable to any purchase made through the website www.koesio-parfums.com.

By accepting these General Terms and Conditions of Sale, you declare that you have reached the age of majority in your country, state, or province of residence, and that you have given us consent to allow any minor under your supervision to purchase from this online sales site.

The use of our products for any illegal or unauthorized purpose is prohibited.

MORAFLOR retains the possibility to modify these General Terms and Conditions of Sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the CLIENT.

Article 3. Prices

The prices listed on the product pages of the internet catalog are in Euros (€) all taxes included (VAT) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

MORAFLOR reserves the right to modify its prices at any time, however, it is understood that the price listed in the catalog on the day of the order will be the only one applicable to the CUSTOMER.

The products remain the property of www.koesio-parfums.com until full payment of the price by www.koesio-parfums.com.

Products on promotion will be indicated by a "PROMOTION" label or by a crossed-out price; our promotions are valid within the limits of available stock at the time of the order and during the display period.

For CLIENTS whose orders are shipped to Metropolitan France and to most countries of the European Union, www.koesio-parfums.com is required, in accordance with current law, to charge VAT.

For CLIENTS outside the European Union and Overseas Departments and Territories, orders are not subject to VAT but may be subject to local taxes and customs duties in the receiving country. These rights and amounts are not the responsibility of www.koesio-parfums.com. They are the responsibility of the CLIENT.

Warning: Any inaccurate information provided by the CLIENT in order to evade VAT may result in civil fines and criminal proceedings.

The prices of the Products indicated on the website www.koesio-parfums.com do not include processing and shipping fees, which are charged in addition to the price of the purchased Products and depending on the total amount of the order.

If the Client requests a faster or more expensive shipping method than the standard shipping, the additional delivery costs, as they appear at the time of order validation by the Client, are entirely at his expense.

For shipments to Metropolitan France in mountainous areas, Corsica, or French islands, additional delivery charges, as they appear at the time of order validation by the Client, are entirely at his expense.

Article 4. Order

Contractual information is presented in French and will be the subject of confirmation containing this contractual information no later than at the time of delivery. MORAFLOR reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order.

To order Products on the Website www.koesio-parfums.com, the CLIENT must create an account by providing the required information on the registration form.

To this end, the CLIENT declares to provide complete personal information, not erroneous in nature, allowing for precise identification in any situation. Any fanciful, slanderous personal information may result in the closure of the CLIENT's account and the cancellation of his Order.

The account creation section is accessible directly from the main menu bar. Upon each visit, the CLIENT, if he wishes to order or consult his account (order status, personal information, etc.), must identify himself using this information.

Article 5. Payment

The price of the Products and the logistic preparation and delivery fees are payable in full by the CLIENT at the time of placing the Order.

If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable.

After choosing the payment method by bank transfer, and upon validation of the order, the Client receives a confirmation of the registration of his order. To finalize his payment and trigger the processing of his order, the Client must make the transfer corresponding to the amount of his order to the bank account of MORAFLOR, the details of which are communicated to the Client at the end of the order.

Upon receipt of the transfer, the order will be processed, and the Client will be informed by email.

After choosing the payment method by Paypal, the Client is redirected to the secure interface of the payment system to securely enter his Paypal personal details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by Paypal is irrevocable.

Article 6. Right of Withdrawal

In accordance with article L121-21 of the Consumer Code, the Client has a period of fourteen working days from the date of receipt of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty.

The products must be returned in their original packaging, unused, accompanied by the original signed delivery note. Return costs are borne by the Client.

Article 7. Delivery

The delivery of the Products will take place, after recording the payment of the Order, at the delivery address indicated by the CLIENT during the placing of the Order. An email will be sent to the CLIENT to inform them of the shipment of the Products. The CLIENT has the option to choose between different delivery methods.

Shipping costs are calculated according to the chosen delivery method (home, relay point, post office, etc.), the weight of the package, and the destination.

Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated, and the Client reimbursed.

Article 8. Warranty

All products offered by the company MORAFLOR on the website www.koesio-parfums.com benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the company MORAFLOR which will take it back, exchange it, or refund it. All complaints, exchange requests, or refunds must be made by post to the following address: MORAFLOR, ZAC PILON LOT N°7 - 06460 SAINT-VALLIER-DE-THIEY (GRASSE-FRANCE), within thirty days after delivery.

Article 9. Liability

The company MORAFLOR has, for all stages of access to the site, the ordering process, delivery, customer service, or subsequent services, only an obligation of means. MORAFLOR's liability cannot be engaged for any inconvenience or damage inherent in the use of the internet network, in particular data loss, intrusion, virus, service interruption, and other involuntary problems, or any event qualified as force majeure, in accordance with case law.

The computerized records kept in the information systems of MORAFLOR under reasonable security conditions will be considered as proof of communication, orders, and payments made between MORAFLOR and the Client.

Article 10 - Securing

The performance by MORAFLOR of all or part of its obligations, including delivery, will be suspended in the event of the occurrence of a fortuitous event or force majeure that would hinder or delay its performance. Such events include, but are not limited to, war, riots, insurrection, social unrest, strikes of all kinds. MORAFLOR will inform CLIENTS of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. If this suspension continues beyond a period of fifteen days, the CLIENT will have the option to terminate the current order, and the price of the ordered Products and paid delivery costs will then be refunded.

Article 14. Applicable Laws and Jurisdiction

The General Terms and Conditions of Sale are subject to French law. Only the French version of these General Terms and Conditions of Sale is valid. In the event of difficulties arising from the Order, delivery of the Products, and more generally the performance of the sale, the CLIENT will have the option, before any legal action, to seek an amicable solution, notably with the assistance of a consumer association or any other advisor of his choice.
